Ten years after the call for the adoption of electronic medical records (EMR), nearly every healthcare system has converted from hard copy, paper records. The electronic evolution continues as mobile electronic devices are now being used in rendering and recording patient healthcare. With advancements in technology, there has been increased uncertainty in dealing with the novel clinical, preservation and production issues of patient medical records.

Since a universal legal precedent has yet to be established on many EMR issues, we will discuss rulings on recent cases of interest. In reviewing these cases, we will place special emphasis on issues involving the audit trail and health information exchanges that may impact the standard of care in medical professional liability cases. We will also cover EMR spoliation issues, new medical liability theories and arguments, use of expert witnesses in EMR litigation and new peer review protection wrinkles.

During this webinar, we will:

  • Understand how the EMR and related mobile technology are affecting the clinical practice of medicine.
  • Discuss the very latest court decisions, trial tactics and liability issues associated with the EMR in medical professional liability cases.
  • Develop "best practices" and prospectively identify and prevent potential issues regarding the preservation, production and remote exchange of health information from the EMR.
