The US Court of Appeals has ruled in favor of the Biden Administration to enforce several COVID-19 vaccination and testing mandates, including The Occupational Safety and Health Administration (OSHA) emergency temporary standard for private sector businesses announced in September. This OSHA ETS requires businesses with more than 100 employees to implement a mandated vaccination policy or conduct weekly testing for unvaccinated employees with a valid exemption.
OSHA says it will not issue any citations for violations before January 10, 2022, and will begin issuing citations on February 9, 2022. This decision is likely to be appealed and forwarded to the Supreme Court.
